Terms of Use

These Terms of Use ("Terms") govern your use of the FitPlan mobile application ("FitPlan" or the "App"), published by ASSSK LLC ("we", "us", "our"). By downloading, installing, or using FitPlan, you agree to these Terms. If you do not agree, please do not use the App.

1. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use FitPlan on devices you own or control, for your own personal and non-commercial use. You may not redistribute, resell, reverse engineer, or create derivative works from the App except as permitted by applicable law.

2. Health and fitness disclaimer

FitPlan is a general-purpose fitness logging and planning tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The training plans, exercise suggestions, weight recommendations, and other information presented in the App are for general informational purposes only.

You should consult a qualified physician or other licensed healthcare professional before beginning any exercise program, especially if you have any medical condition, injury, or concern about your health. Do not disregard professional medical advice or delay seeking it because of anything you have read in the App.

You are solely responsible for how you use FitPlan and for any exercise activity you perform. Exercise carries inherent risks, including the risk of injury. By using FitPlan you acknowledge these risks and agree to exercise within your own capabilities and under conditions that are safe for you.

3. Your data

FitPlan stores all of your data locally on your device and does not transmit it to us. You are responsible for backing up your data if you wish to preserve it. Uninstalling the App, factory-resetting your device, or clearing the App's storage will remove all locally stored FitPlan data. For details, see our Privacy Policy.

4. No warranty

FitPlan is provided "as is" and "as available", without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the App will be error-free or that any defects will be corrected.

5. Limitation of liability

To the maximum extent permitted by applicable law, ASSSK LLC, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, loss of profits, or loss of use, arising out of or in connection with your use of FitPlan, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

6. Third-party app stores

If you obtained FitPlan from a third-party app store (for example, the Apple App Store or Google Play), your use of the App is also subject to the terms and policies of that store. In the event of a conflict, these Terms govern your relationship with ASSSK LLC, while the store's terms govern your relationship with that store.

7. Changes to the App and these Terms

We may update, modify, or discontinue features of FitPlan at any time without notice. We may also update these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. Your continued use of the App after an update constitutes acceptance of the revised Terms.

8. Governing law

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of laws principles. You agree that the competent courts of Japan shall have exclusive jurisdiction to settle any such dispute.
